An Act Relative to Real Property Tax Abatements for Active
Duty Military Personnel in the Town of Sutton

The abatement shall apply to deployments beginning with fiscal 2025 and forward.
For deployment periods in the current fiscal year (July to June) the applicant shall file on or after January 1st,
For deployment periods in a previous fiscal year, the applicant may file at any time.
During your deployment you must own your property and occupy the property as your domicile. "Your domicile is where your principal and legal home is located, your family, social, civic and economic life is centered and you plan to return whenever you are away. You may have more than one residence, but only one domicile".
Applicant must provide proof of deployment to a foreign country:
Must submit a letter from Commanding Officer specifying the name of foreign country and active duty dates or a copy of Orders - Title 10 of the U.S. code, as long as they state where deployed and the dates of deployment The Board of Assessors may require additional proof.
The Board of Assessors shall calculate the abatement to be granted on a pro rata basis, i.e.: The actual real estate tax on the applicant's domicile for the fiscal year divided by the number of days in that fiscal year, multiplied by the number of days the applicant was deployed in a foreign country in that fiscal year.
The applicant must file an abatement form for each year of deployment filling out Section C. Check the "other" box and write "Military Foreign Deployment" on the - abatement form .
Adopted by the Sutton Board of Assessors on sixth day of January, 2026.
